Acceptance of Quotation and/or Payment
Acceptance of a quotation or payment of a deposit to Senso Studio will be considered an agreement to the following terms and conditions. Please read and ensure full understanding of the terms below. If anything is unclear, please contact us.
1) Pricing and Validity
1.1. All costs provided exclude VAT where applicable and are valid for thirty days from the date of the quotation.
2) Quotation and Payment
2.1. Quoted costs are based on our experience, anticipated creative, time, and production requirements. Additional charges may apply if significant variations occur, and the client will be notified in advance.
2.2. No creative or development work will commence until Senso Studio receives approval of the quotation and a minimum deposit of 50% of the agreed costs, unless otherwise agreed in writing. Once work has begun, the deposit becomes non-refundable.
2.3. The balance of payment will be due in full on invoice upon project completion. Failure to make final payment may result in project delays. Payments should be made within 7 days of the invoice. Delays in payment may incur an additional charge of 8% added to each project invoice.
3) Project Stages and Timeline
3.1. If a project is approached in stages, each stage must be paid in full upon completion before progressing to the next stage.
3.2. If a project extends beyond twelve weeks from the approval of the quotation or exceeds the estimated timeline, Senso Studio reserves the right to invoice 25% of any outstanding balance, with the remaining 25% payable on completion.
4) Third-Party Services
4.1. Any printing, fulfillment, mailing, or third-party services provided by Senso Studio will require an up-front payment of 100% of the agreed cost, at the discretion of Senso Studio.
5) Work Commencement and Timeline
5.1. Work usually starts within ten working days of deposit receipt. Timelines provided are estimated and depend on client cooperation, provision of information, resource, and approval.
6) Creative Options and Amendments
6.1. Costs allow for a minimum of two creative options per brief. If the client is not satisfied after the third round, Senso Studio reserves the right to potentially end the agreement with no refund.
6.2. Costs include a maximum of three sets of client amendments. Additional charges may apply after this limit.
7) Sign-Off and Approval
7.1. The client must provide written approval at the end of each project stage. No further development can occur without written approval. Amendments after approval may incur additional charges.
8) Meetings and Disbursement
8.1. Occasional meetings are allowed, but additional charges may apply for time spent beyond reasonable lengths.
8.2. Projects may be subject to a standard disbursement charge to cover in-house color printing, travel, postage, etc.
9) Excluded Costs
9.1. Costs exclude VAT, print, commissioned illustration or photography, image retouching, image scanning, copywriting, postage, in-house color print-outs, travel exceeding standard disbursement charge, web hosting, couriers, and other third-party costs.
10) Ownership and Copyright
10.1. Ownership of designs, artwork, and rights to design and artwork remains with Senso Studio until full payment is received. Full copyright and ownership for final work are transferred to the client upon full payment.
11) Indemnification and Liability
11.1. The client agrees to indemnify and hold Senso Studio harmless from any claims, actions, losses, or expenses related to our work. Senso Studio is not liable for any loss caused by third parties.
12) Defects and Claims
12.1. The client must report any defects or problems related to our work within 30 days of the final invoice date.
13) Web Hosting
13.1. Senso Studio offers web hosting, and it is recommended for quality control, especially for websites with CMS or e-commerce. Senso Studio cannot guarantee 100% uptime or accept responsibility for errors or losses on hosted websites.
14) Color Variations
14.1. Colors may vary between proofs, screen displays, and final printed items due to several factors. Senso Studio cannot guarantee 100% consistency and accuracy of color.
15) Handling of Copy and Images
15.1. The client is responsible for providing most copy and images. Senso Studio can provide a copywriting service or additional images at extra cost if required.
16) Print Suppliers
16.1. Clients are not bound to use Senso Studio for printing but are recommended for quality control.
17) Additional Services
17.1. Senso Studio collaborates with various partners for services beyond in-house capabilities.
18) Confidentiality
18.1. Senso Studio will not use or disclose proprietary client information and will protect it as confidential.
19) Changes to Terms
19.1. These terms supersede previous versions and apply to all projects. Senso Studio reserves the right to change or modify these terms at any stage with immediate effect. By agreeing to these terms, your statutory rights are not affected.
20) Credit & Acknowledgement
28) Appropriate credit and acknowledgment for work produced by Polar Creative Studio should be attributed to Polar Creative Studio where possible (for instance written in small text on the back of a printed item or at the bottom of a website) and may be referenced for the agency’s promotional purposes unless otherwise (in exceptional circumstances) prearranged with the client.
